Acceptance of the general conditions of sale

The contract stipulated between Micromec di Borgialli Roberto and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Micromec di Borgialli Roberto.

This acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the general and payment conditions transcribed below. If the Customer is a consumer, once the online purchase procedure has been completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and / or things, caused by the non-acceptance, even partial, of an order.

How to purchase

The Customer can only purchase the products present in the electronic catalog of Micromec di Borgialli Roberto.it at the time of placing the order and viewable online at the address (URL) www.micromecgroup.com, as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its characteristics but differ in color, size, accessory products shown in the figure.

All purchase support information is intended as a simple generic information material, not referable to the real characteristics of a single product. Correct receipt of the order is confirmed by Micromec di Borgialli Roberto.it by means of an e-mail reply, sent to the e-mail address supplied by the Customer.

This confirmation message will contain the date and time of execution of the order and a ‘Customer Order Number’, to be used in any further communication with Micromec di Borgialli Roberto.

The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document.

In case of non-acceptance of the order, Micromec di Borgialli Roberto guarantees timely communication to the Customer.

Terms of payment: Advance Bank Transfer.

The customer, after placing the order through the micromecgroup.com website, will receive an invoice directly from Micromec di Borgialli Roberto with the details of the amount to be cleared.

The products will be shipped after verifying the effective collection of the transfer by the administration of Micromec di Borgialli Roberto.

The dispatch of the order will take place only upon the actual crediting of the amount due to the current account of Micromec di Borgialli Roberto which must take place within 7 working days from the date of acceptance of the order. Beyond these deadlines, the order will be deemed automatically canceled. The purpose of the bank transfer must include: the order reference number;

Delivery methods and costs

Micromec di Borgialli Roberto can accept orders with delivery in Italian territory and orders with delivery in other countries can be managed by agreement. In this case, the shipping costs will be calculated and communicated to the customer after the order and the payment method will be an advance bank transfer.

The cancellation of the order is possible up to the moment of the order fulfillment which takes place with the issue of the transport document or invoice.

For every order placed on www. micromecgroup.com, Micromec di Borgialli Roberto issues an invoice for the material shipped, sending it by e-mail to the order holder, pursuant to Article 14 of the Presidential Decree 445/2000.

For the issuance of the invoice, the information provided by the Customer at the time of the order is valid.

No change in the invoice will be possible after it has been issued.

Delivery costs and / or any ancillary costs are charged to the customer. The payment of the goods by the Customer will be made using the method chosen at the time of the order.

Nothing more is owed by the Customer than the total order shown at the end of the purchase procedure.

Shipping costs are calculated based on the type of transport chosen by the customer:
– Half Recipient. The customer undertakes to collect the products ordered, from the site www.micromecgroup.com, through his own staff. Upon collection, the customer must submit order confirmation emails to the personnel in charge of product delivery. Any other persons appointed by the customer to collect the goods must present a proxy signed by the customer.
– Port assigned. When placing the order, the customer must indicate with which courier he intends to receive the products ordered through e-commerce. Shipping costs are fully charged to the customer. In case of damage to the products by the courier, nothing will be requested from Micromec di Borgialli Roberto.
– Free Port charged on the invoice. Micromec di Borgialli Roberto assumes responsibility for the transport. The transport costs will be communicated upon receipt of the invoice, issued by Micromec di Borgialli Roberto, calculated on the basis of the products purchased by the customer and the delivery destination.

No responsibility can be attributed to Micromec di Borgialli Roberto in case of delay in order fulfillment or delivery of the order.
The delivery of what is ordered means at street level unless otherwise communicated by our customer service.

Upon delivery of the goods by the courier, the Customer is required to check:
– that the number of packages delivered corresponds to what is indicated on the invoice;
– that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps)

Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately contested, affixing WRITTEN CONTROL RESERVE (SPECIFYING THE REASON FOR THE RESERVE, eg. “Punctured packaging”, “crushed packaging” , etc.) on the courier’s proof of delivery. Once the courier’s document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 5 days of delivery by fax or registered letter with return receipt.

In case of non-collection within 5 working days of the material present in storage at the courier’s warehouses due to repeated impossibility of delivery to the address indicated by the Customer at the time of the order, the order will be returned to the Micromec warehouses in Borgialli. Roberto.

Any costs due to storage will be charged to the customer.

Once the courier’s document has been signed, the Customer will not be able to make any objection about the external characteristics of what has been delivered. In any case, Micromec di Borgialli Roberto reserves the right to request further documentation from the customer to prove the actual damage.

Right of withdrawal

Pursuant to art. 64 et seq. of Legislative Decree no. 206/2005, if the customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating a reference to VAT number in the order form to Manhattanshop.it) , has the right to withdraw from the purchase contract for any reason within 30 days of receipt of the goods, without any penalty and without prejudice to what is indicated in point 3 below.

To exercise this right, the customer must enter a withdrawal request in which it will also be necessary to indicate the bank details necessary to return the sums paid; the system will send the customer by e-mail a paper form which must be printed and sent by registered letter with acknowledgment of receipt within 14 days from the date of receipt of the goods to: Micromec di Borgialli Roberto, Viale Europa, 7 – 10081 Castellamonte TO. Upon receipt of the registered letter, Micromec will send the customer the form for exercising the right of withdrawal via e-mail with an authorization number which must be attached to the outside of the envelope in which the product will be physically placed and sent to Micromec within 14 days of authorization.

The right of withdrawal is however subject to the following conditions: the law applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the purchased product (eg: accessories, attached software, etc …); the law does not apply to audiovisual products or sealed computer software (including those attached to hardware material), once opened; the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc …); to limit damage to the original packaging, we recommend placing it in a second box, on which to affix the label showing the RMA number (return authorization code); in all cases, the affixing of labels or adhesive tapes directly to the original product packaging should be avoided; the asset subject to the exercise of the right of withdrawal must bear the same serial number (IF IT EXISTS) present in the Micromec sales invoice of Borgialli Roberto; if the goods have a serial number different from what is indicated on the invoice, the return will not be accepted and the product will be made available to the customer for its return, at the same time canceling the request for withdrawal; the shipping costs for returning the goods are charged to the customer; the shipment, up to the certificate of receipt in our warehouse, is under the complete responsibility of the customer; in case of damage to the goods during transport, Micromec di Borgialli Roberto will notify the customer of the incident (within 5 working days from receipt of the goods in its warehouses), to allow him to promptly file a complaint against the courier chosen by him and obtain reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for its return, at the same time canceling the request for withdrawal; Micromec di Borgialli Roberto is not responsible in any way for damage or theft / loss of goods returned by uninsured shipments;

ATTENTION: Micromec staff of Borgialli Roberto are not authorized to collect goods whose packaging does not bear the RMA number.

Upon its arrival at the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the package and / or the original packaging are damaged, Micromec di Borgialli Roberto will deduct a percentage from the refund due, in any case not exceeding 10% of the same, as a contribution to the restoration costs. Without prejudice to any repair costs for damage to the original packaging, Micromec di Borgialli Roberto will refund the customer the amount already paid for the purchase of the goods, within 14 days of his return, by means of a reversal of the amount charged by credit card or by bank transfer.

In the latter case, it will be the customer’s responsibility to promptly provide the bank details on which to obtain the reimbursement (Code IBAN and Bank of the invoice holder). The right of withdrawal is totally lost, for lack of the essential integrity of the goods (packaging and / or its contents), in cases where Micromec di Borgialli Roberto. make sure:

In case of forfeiture of the right of withdrawal, the goods will remain at the Micromec headquarters in Borgialli Roberto, available to the Customer for collection at his expense.

The credit in favor of the customer can be partial in the event that the goods have suffered a decrease in value, such as:

  • Even partial use of the goods and any consumables
  • Damaged packaging or in any case not intact as received

Guarantees

All products sold by Micromec di Borgialli Roberto are covered by the manufacturer’s conventional warranty and by the 12-month warranty, in case of sale to professional customers (Resellers) with VAT number, and 24 months in case of sale to users with VAT number. non-professional (End User) for lack of conformity, pursuant to Legislative Decree 206/05. To use the warranty, the Customer must keep the invoice (or DDT) that he will receive via e-mail in PDF format. The exercise of the Warranty may provide for the request for assistance to authorized service centers in the area and / or follow the procedures illustrated in the documentation inside the product packaging.

The manufacturer’s conventional warranty is provided in the manner illustrated in the documentation inside the product packaging. If, following intervention by an Authorized Service Center, the defect is not covered by the manufacturer’s conventional warranty, the Customer will be charged for any costs of verification and restoration required by the Authorized Service, as well as transport costs, if supported by Micromec di Borgialli Roberto.
The 24-month warranty pursuant to Legislative Decree 206/05 applies to products with a lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and as provided in the attached technical documentation. This guarantee is reserved for the Final Consumer (natural person or company who purchases the goods for purposes not related to their professional activity). In case of lack of conformity, Micromec di Borgialli Roberto will restore the conformity of the product by repairing / replacing or reducing the price, at no cost to the customer, until the contract is terminated. If, following intervention by an Authorized Service Center, the defect does not result in a lack of conformity pursuant to Legislative Decree 206/05, the Customer will be charged for any costs of verification and restoration required by the Authorized Assistance, as well as transport costs if incurred by Micromec di Borgialli Roberto.

The replacements in case of DOA (Dead On Arrival: product not working on delivery) take place only if expressly provided for by the manufacturer. The timing of replacement or repair of the product depends exclusively on the policies of the manufacturer.

In the event that, for any reason, it is unable to return a product under warranty (restored or replaced) to its customer, Micromec di Borgialli Roberto may proceed at its discretion to refund the amount paid taking into account the use of the asset. or its replacement with a product of equal or superior characteristics.

The timing of repair or replacement of the product depends exclusively on the manufacturer’s policies and no damage can be requested from Micromec di Borgialli Roberto for any delays in carrying out repairs or replacements.

In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc …); to limit damage to the original packaging, we recommend placing it in a second box; in all cases, the affixing of labels or adhesive tapes directly to the original product packaging should be avoided.

The Customer will be provided with an authorization number for the return of the product (RMA) which must be indicated on the outside of the packaging, following the instructions provided directly in the relevant authorization e-mail.

ATTENTION: Micromec staff of Borgialli Roberto are not authorized to collect goods whose packaging does not bear the RMA number.

Applicable law

The sales contract between the customer and Micromec di Borgialli Roberto is concluded in Italy and governed by Italian law. For the solution of civil and criminal disputes deriving from the conclusion of this distance sales contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference forum of his town of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Ivrea.
